Chinese Exclusion Case (Chae Chan Ping v. United States) case brief

Chinese Exclusion Case (Chae Chan Ping v. United States) case brief summary
130 U.S. 581 (1889)

CASE SYNOPSIS
Appellant challenged an order from the Circuit Court of the United States for the Northern District of California, which held that appellant was not entitled to enter the United States and that appellant was not restrained of his liberty. The United States denied entry under an act that was a supplement to an act titled "an act to execute certain treaty stipulations relating to Chinese," Act of Congress of October 1, 1888, 25 Stat. 504, ch. 1064.

CASE FACTS
Appellant was a Chinese laborer who was denied entry into the United States and was not restrained of his liberty when the United States excluded entry under an act that was a supplement to an act titled "an act to execute certain treaty stipulations relating to Chinese," Act of Congress of October 1, 1888, 25 Stat. 504, ch. 1064. Appellant challenged the refusal to grant entry because treaties existed between China and the United States that allowed entry.

DISCUSSION

  • The United States Supreme Court reviewed the general character of the treaties and the legislation of Congress to carry them into existence.
  • The Court examined the limitation to immigration of certain classes from China and the necessity to preserve civilization.
  • The Court held that treaties were of no greater legal obligation than the act of Congress.
  • The Court affirmed the denial of entry because the government of the United States, as a part of the sovereign powers delegated by the Constitution, had the right to exclude Chinese laborers.
CONCLUSION
The Court affirmed the refusal of the United States to grant appellant entry into the United States because the legislature had the authority under the sovereign powers delegated by the Constitution to exclude foreigners. The treaties with China did not strip the legislation of the power to exclude Chinese laborers.
