SYNOPSIS: A state court granted judgment for petitioner administrator in its action against respondent railway company trustees under the Federal Employers' Liability Act, for the negligent death of an employee. The Supreme Court of Missouri reversed the judgment and certiorari was granted.
-Petitioner, the administrator of the estate of L.E. Haney, a railroad employee, sued Respondents, two railroad companies, under the Federal Employers’ Liability Act (”FELA”) for Haney’s death, which occurred while he was working.
-There was evidence from which it might be inferred that the end of the mail hook struck the deceased in the back of the head.
CONCLUSION: The judgment in favor of the trustees was reversed and remanded.
